These Terms of Service (the “Terms”) govern your use of EmployLabs, our AI recruiting platform at app.employlabs.ai (the “Service”). Browsing our website, employlabs.ai, does not make you a customer or bind you to these Terms. Please read them carefully.
In these Terms, “EmployLabs”, “we” and “us” mean EmployLabs, run by Weemploy Co. The “customer”, “you” and “your” mean the company or person that signs up for or uses the Service.
1. Who these terms are between
These Terms are a contract between EmployLabs and the customer. If you accept them for a company, you confirm that you have authority to bind that company, and “you” then means the company.
You accept these Terms when you create an account, sign an order that refers to them, or use the Service. If you do not agree, do not use the Service.
If you sign an order form or another written agreement with us, it applies together with these Terms. If the two conflict on a point, the signed agreement wins on that point.
The Service is for businesses. You must be at least 18 to use it.
Candidates and referrers whom you contact through the Service are not parties to these Terms. Our Privacy Policy and Privacy choices page explain their rights.
2. The service
EmployLabs gives recruiters and hiring teams assistants that do recruiting work:
- Meera, an AI agent, finds candidates, runs outreach, schedules interviews and keeps the hiring pipeline moving.
- Naira, an AI interviewer, interviews candidates by voice and produces recordings, transcripts and scored reports for your hiring.
- Zia, our career strategist, calls candidates and referrers and messages them on WhatsApp.
The agents act on your instructions: the roles you create, the criteria you confirm and the settings you choose. Your settings decide which actions need your approval first. You review and approve what your settings require, and you can change your settings at any time.
We keep improving the Service and may change or remove features. We will give you notice before a change that materially reduces what you have paid for.
3. Accounts and seats
- You need an account to use the Service. Give us accurate details and keep them up to date.
- Each seat is for one person. Do not share sign-in details between people.
- You are responsible for everything done under your account, including by the people you invite, and for keeping sign-in details safe.
- Tell us at once at saurabh@weemploy.world if you think someone has used your account without permission.
- The number of seats and what each plan includes are set on our pricing page or in your order.
4. Your responsibilities
When you use the Service, you must:
- Use it lawfully. Follow the employment, anti-discrimination, data protection and anti-spam laws that apply where you hire and where your candidates live.
- Have a lawful basis and give notice. Have a lawful basis to process candidates' personal data, and give candidates any notice the law requires, for example that they may be contacted about roles, interviewed by an AI agent and recorded.
- Not send spam. Outreach must follow anti-spam law and honour opt-outs. Do not remove or work around the unsubscribe link in outreach emails or our do-not-contact records.
- Describe roles accurately. Give accurate information about each role, the hiring company and, where you state them, pay and conditions.
- Look after your team. Make sure everyone who uses your account follows these Terms.
5. Acceptable use: hire responsibly
Hiring affects people's lives. You must not use the Service to:
- Discriminate. Do not treat anyone less favourably because of a protected characteristic, such as race, caste, religion, sex, gender identity, sexual orientation, age, disability, pregnancy, marital status or national origin, and do not set role criteria that do so.
- Deceive. Do not advertise a role that does not exist, misrepresent who you are, or mislead people about the job or its pay.
- Harass. Do not keep contacting someone who has asked you to stop, or contact people in a way that is abusive.
- Take our data. Do not scrape, copy, bulk-export, resell or share the candidate profiles, contact details or other data the Service provides, except for your own recruiting through the Service.
- Misuse AI interviews. Do not run interviews for roles that do not exist, use them to collect data for any other purpose, record people without the notice the law requires, or alter or misrepresent an interview report.
- Let AI decide alone. Do not make a final hiring decision based only on AI output, without a person reviewing it.
- Attack or copy the Service. Do not reverse engineer it, build a competing product from it, upload malicious code, overload it, or test its security without our written permission.
We may suspend any activity that breaks this section (see Suspension and termination).
6. Connected accounts
You can connect third-party accounts to EmployLabs, such as Gmail and Google Calendar. When you connect one, you authorise us to act in that account for you, within the permissions you grant. For example, we send outreach from your mailbox, draft replies, track candidate replies, and create, update or cancel interview events.
You confirm that you are allowed to connect the account. Your use of a connected service is also governed by that provider's own terms, such as Google's terms of service. We are not responsible for third-party services.
You can disconnect an account at any time in Settings. The features that depend on it then stop, such as sending outreach from your mailbox or booking interviews in your calendar. Our Privacy Policy explains how we handle Google user data.
7. Fees, credits and billing
- Fees and plans. Your fees, plan and seats are as shown on our pricing page or in your order. If the two differ, your order applies.
- Credits. Some plans include credits, which the Service uses for work such as sourcing, outreach and interviews. Your plan or order says how many credits you get and how they are used.
- Taxes. Prices do not include taxes unless stated. You pay any taxes that apply to your purchase.
- Payments. We take payments through Razorpay. You authorise us and Razorpay to charge the payment method you give us.
- Late payment. If you do not pay on time, we may suspend the Service after giving you notice, until you pay.
- Price changes. If we change our prices, the new prices apply from your next billing period after we give you notice.
- Cancellation and refunds. You can stop using the Service at any time. Fees and credits already paid are not refundable, unless the law requires a refund or your order says otherwise.
8. Your data
You own your data. “Customer data” means the data you and your users put into the Service, and the data the Service creates for you: roles, the candidates in your workspace, interview recordings, transcripts, reports and messages. As between you and us, you own customer data.
Data we supply. Customer data does not include the profile and contact data that the Service supplies from public sources and data providers. That data is licensed to you for your recruiting through the Service, and you do not own it. The limits in Acceptable use and Third-party data sources apply.
Our licence to use it. You give us a licence to host, copy, process, send and display customer data only as needed to provide, secure and support the Service for you, and as our Privacy Policy describes. We do not sell customer data. We do not use your workspace data to train AI models for other customers.
Export and deletion. You can ask us to export your customer data while your account is active. After your contract ends, we delete customer data within 30 days, after you have had the chance to export it.
9. Data protection
When we process personal data in your workspace, you are the controller (under India's Digital Personal Data Protection Act, 2023, the data fiduciary) and we are your processor. As your processor, we:
- process it only on your instructions, as set by these Terms, your settings and your use of the Service, and as the law requires;
- let only the EmployLabs staff who need it access it;
- protect it with the security measures described in our Privacy Policy;
- use only the sub-processors listed on our Sub-processors page, each bound to protect the data, and tell you about changes to that list if you ask to be notified;
- help you answer candidates who ask to see, correct or delete their data, and pass on to you any such request we receive about your workspace;
- delete it within 30 days after your contract ends, after you have had the chance to export it.
You are responsible for the instructions you give us, for having a lawful basis and giving candidates the notices the law requires, and for deciding how to answer candidates' requests about your workspace.
10. AI output
- The Service uses AI to find and score candidates, write messages, run interviews and write reports. AI can be wrong, incomplete or biased.
- Review AI output, including scores, reports and drafts, before you rely on it.
- The Service shows scores and evidence. It does not make hiring decisions. No final hiring decision may be made automatically: a person on your team must review the evidence and decide.
- You are responsible for your hiring decisions, and for the actions your settings allow the agents to take without your approval.
- If you think an AI output is wrong or unfair, tell us at saurabh@weemploy.world so we can look into it.
11. Confidentiality
Each of us may receive the other's confidential information, such as non-public business, product, pricing or customer information. The party that receives it will use it only for these Terms, protect it with reasonable care, and share it only with people who need it and are bound to keep it confidential.
This does not cover information that is public through no fault of the receiving party, that it already had or developed on its own, or that it received lawfully from someone else. A party may disclose confidential information when the law requires it, and will tell the other party first where the law allows.
12. Intellectual property
- Ours. We own the Service, including our software, AI agents, designs, and the EmployLabs name and brands. These Terms give you the right to use the Service while your account is active. They do not transfer ownership of anything to you.
- Yours. You own your customer data, your brands and the materials you provide.
- Feedback. If you send us feedback or ideas, we may use them freely, without owing you anything.
13. Third-party data sources
To help you find candidates and companies, the Service shows professional profile data and contact details from public sources and licensed data providers. They are listed on our Sub-processors page.
We do not control those sources, so we cannot promise that their data is complete, accurate or up to date. Check it before you rely on it. Use it only for your own recruiting through the Service, and follow the law and every opt-out when you use it.
14. Disclaimer of warranties
We provide the Service with reasonable care and skill. Apart from that, and to the extent the law allows, the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, that AI output will be accurate, or that you will hire anyone through it.
To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Each party confirms that it has the right to enter into these Terms.
15. Limitation of liability
- No indirect losses. Neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or goodwill, even if it was told they could happen.
- A cap. Each party's total liability under these Terms is limited to the fees you paid us for the Service in the 12 months before the claim.
- What the limits do not cover. These limits do not apply to your obligation to pay fees, your indemnity obligations, your breaches of Acceptable use, or any liability that the law does not allow to be limited.
16. Indemnity
You protect us. If someone makes a claim against EmployLabs because of your customer data, your hiring decisions, your outreach, or your breach of these Terms or the law, you will defend us and pay the resulting damages, costs and reasonable legal fees.
We protect you. If someone claims that the Service, used as these Terms allow, infringes their intellectual property rights, we will defend you and pay the resulting damages, costs and reasonable legal fees. We may instead change the Service so it no longer infringes, get you the right to keep using it, or end the affected part and refund any fees you prepaid for the unused period. This does not cover claims caused by your data, your changes to the Service, or your use of it with things we did not provide.
How it works. The party asking for protection must tell the other party promptly, let it control the defence and any settlement, and help reasonably. Neither party may settle a claim in a way that admits fault for the other without the other's consent.
17. Suspension and termination
- You can leave. You can close your account at any time by telling us at saurabh@weemploy.world.
- Serious breach. Either party may end these Terms if the other seriously breaches them and does not fix the breach within a reasonable time after notice.
- Suspension. We may suspend all or part of the Service if you do not pay, if you break the acceptable use rules, or if we must, to protect the Service, other users or candidates, or to comply with the law. Where we can, we tell you first, and we lift the suspension once the problem is fixed.
- Your data when you leave. You can export your customer data before the contract ends. We delete it within 30 days after the contract ends, after you have had that chance. We keep billing records as long as tax law requires, and a minimal do-not-contact record so that opt-outs are honoured. Deleted data leaves our backups on their normal rotation.
- What survives. Terms that by their nature should last after the contract ends do so, including fees owed, confidentiality, intellectual property, the disclaimer of warranties, the limitation of liability, indemnity and governing law.
18. Governing law and courts
These Terms, and any dispute about them or the Service, are governed by the laws of India. The courts of the city of our registered office in India have exclusive jurisdiction over any such dispute.
19. Changes to these terms
We may update these Terms. We will post the new version on this page with a new date. For material changes, we give you notice by email or in the product before they take effect.
If you keep using the Service after a change takes effect, you accept the new Terms. If you do not agree, stop using the Service and close your account.
20. General
- These Terms, together with any order you sign, are the whole agreement between us about the Service.
- If a court finds part of these Terms unenforceable, the rest stays in force.
- If we do not enforce a right straight away, we do not give it up.
- You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
- Neither party is liable for a delay or failure caused by events beyond its reasonable control.
Questions and legal notices about these Terms go to saurabh@weemploy.world. We send notices to you at the email address on your account.
